Overview
Construction Lawyers to meet all your legal needs.
OMW construction attorneys provide all legal services to our construction industry clients. Before the first shovel is turned, we develop, draft, and negotiate construction contracts, and we assist with bidding and buy out. During construction, we assist with contract administration, claims, and change order negotiation. When the project is complete, we assist with project closeout. In the unfortunate event of an unresolved claim, we assist in dispute resolution.
We represent regional and national clients on construction projects ranging from public projects of all types, office buildings, multi-family residential buildings, and industrial Projects. Our clients include public and private owners, general contractors, subcontractors, architects and engineers, sureties, suppliers, lenders, and developers.
We Understand the Construction Business.
Our lawyers have backgrounds in construction and engineering, with hands-on experience working on construction projects. OMW has a long history with industry organizations such as the Associated General Contractors, and the Washington State Bar Association Construction Law Section, including serving on the Section’s executive committee, and more recently, as editors of the Section’s newsletter. Our attorneys regularly give presentations and public articles on construction topics and have contributed to chapters in the Washington Construction Law Deskbook.
We represent public and private owners, contractors, subcontractors, and design professionals in all manner of construction contracts.
- Contract Drafting and Negotiation
- Developing Form Contracts
We represent clients in construction claims arising during project construction and after project completion, including the following:
- Payment Claims, Mechanic's Liens, and Collection
- Impact Claims Due To Delay, Suspension, Acceleration or Disruption
- Differing Site Conditions
- Defective or Ambiguous Specification Claims
Construction Claims Avoidance
We work with our clients during and after construction to control and manage claims. We are committed to making full use of the dispute resolution processes afforded to our construction clients to avoid the more costly alternative of arbitration or litigation.
Mediation, Arbitration, and Litigation
Even with the best intentions, disputes arise and sometimes arbitration or litigation is inevitable. We aggressively represent our clients’ best interests through case management and utilizing legal rules and procedures. We pursue alternate dispute resolution methods when required by contract or in the client’s best interest, and if not, we are licensed in state and federal courts and can see litigation through to the highest levels of appellate courts in order to secure a favorable result for our clients.
